Florida rules to know
- Florida’s official form: HSMV 82050, “Notice of Sale and/or Bill of Sale.” Used as a bill of sale, the seller and purchaser both complete it. You can use it alongside this template or instead of it.
- Seller: file a Notice of Sale. FLHSMV: “As of July 2009, Florida law requires all sellers to file a Notice of Sale,” which removes your name from the vehicle so you are no longer liable for it.
- Buyer: transfer within 30 days. FLHSMV: the title transfer “must be done within 30 calendar days to avoid a late transfer penalty fee.”
- To register, the buyer needs Florida PIP and property damage liability insurance; the odometer reading at purchase goes on the title application.
What else you need
The certificate of title is what legally transfers ownership. Most states also require an odometer disclosure on the title for newer vehicles, and some require a state-specific bill of sale form or notarization. Check your DMV’s website.
Tips for sellers
- Remove your license plates if your state requires it.
- Notify the DMV and your insurer that you sold the car.
- Accept payment you can verify (cash or a cashier’s check confirmed with the bank).
