Counties have strict formatting and recording requirements (margins, page size, required statements, transfer tax forms). Many states and counties publish their own deed forms. Check with your county recorder before recording, and consider having a real estate lawyer or title company prepare or review the deed.
Quitclaim vs warranty deed
A warranty deed guarantees clear title; a quitclaim deed does not. Buyers paying market value should almost always get a warranty deed and title insurance.
Watch out for
- Mortgages: transferring title doesn’t remove anyone from the loan, and may trigger a due-on-sale clause.
- Taxes: transfers can trigger transfer taxes, reassessment or gift tax reporting.
- Recording: an unrecorded deed may not protect the new owner.
